1. About these terms
These Terms and Conditions (“Terms”) govern your use of the websites sportshealing.com and chinmaygupte.com (together, the “Websites”), operated by Sports Healing Ltd (“we”, “us”, “our”). By accessing or using the Websites, you agree to these Terms. If you do not agree, please do not use the Websites.
2. Who we are
Both Websites are operated by Sports Healing Ltd, a private limited company registered in England and Wales under company number 05540087, whose registered office is at Woodlands Grange, Woodlands Lane, Bradley Stoke, Bristol, England, BS32 4JY. Clinical services referred to on the Websites are provided by Mr Chinmay Gupté, registered with the General Medical Council (GMC reference 4342319).
3. Important — medical disclaimer
The Websites — including the Knee Passport and any educational articles, guides, diagrams and videos — are provided for general information and patient education only. They are not medical advice and are not a substitute for a consultation with a suitably qualified healthcare professional.
Using the Websites, contacting us through them, or reading our content does not create a doctor–patient relationship. You should not rely on the Websites to diagnose or treat any condition, and you should always seek the advice of your doctor or another qualified professional about any medical concern.
If you think you may have a medical emergency, call 999 (or your local emergency number) or go to your nearest A&E immediately. Do not delay seeking medical advice because of something you have read on the Websites.
4. Use of the Websites
You may use the Websites for lawful, personal, non-commercial purposes only. You agree not to:
- use the Websites in any way that breaches any applicable law or regulation;
- attempt to gain unauthorised access to, interfere with, or disrupt the Websites or their underlying systems;
- introduce malicious code, or use any automated system to scrape or harvest content;
- copy, reproduce, republish or exploit any content except as permitted in section 5; or
- use the Websites in any way that could damage our reputation or that of any individual.
5. Intellectual property
All content on the Websites — including text, the Knee Passport, graphics, illustrations, logos, and the selection and arrangement of that content — is owned by or licensed to Sports Healing Ltd and is protected by copyright and other intellectual property rights. © Sports Healing Ltd. You may view, download and print content for your own personal, non-commercial use, provided you do not remove any copyright or other notices. You may not otherwise reproduce, distribute, adapt or commercially exploit any content without our prior written permission.
6. Information you submit
Where you submit information through the Websites (for example via a contact or booking form), you confirm that it is accurate and that you are entitled to provide it. We handle the information you submit in accordance with our Privacy Policy. Please do not submit sensitive health information through any channel that is not secure; we will tell you the appropriate way to share clinical details.
7. Appointments, enquiries and fees
The Websites may let you request an appointment, an MRI scan or other services, or make an enquiry. A request is not a confirmed booking until we accept it and confirm it to you.
Any fees payable, together with our arrangements for cancelling or rescheduling an appointment, will be confirmed to you before you commit to a booking. Clinical services are provided subject to the terms agreed with you at that time, and to the terms of the hospital or clinic at which you are seen. 8. Third-party links and services
The Websites may link to third-party websites and services, such as myKneeScan.com and online booking or payment providers. We provide these links for convenience and do not control or endorse those third parties. Your use of a third-party site or service is subject to that provider’s own terms and privacy policy, and we are not responsible for it.
9. No warranties
While we take care to keep the Websites accurate and up to date, we make no warranties or representations that the content is complete, current or error-free, or that the Websites will be available uninterrupted or free of viruses. The Websites and their content are provided “as is” and “as available”.
10. Limitation of liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under English law (including under the Consumer Rights Act 2015).
Subject to that, we will not be liable for any loss or damage arising from your use of, or inability to use, the Websites, or from any reliance you place on their content. This does not affect your statutory rights as a consumer, or any rights or remedies you may have in connection with clinical services actually provided to you, which are governed by the relevant terms of business and the law.
11. Availability of the Websites
We may change, suspend or withdraw all or part of the Websites at any time without notice. We are not liable if the Websites are unavailable at any time or for any period.
12. Privacy and cookies
Our use of your personal information is governed by our Privacy Policy, and our use of cookies and analytics by our Cookie Policy. Please read these documents to understand how we handle your information and how you can control the cookies used on the Websites.
13. Professional regulation
Clinical services referred to on the Websites are provided by Mr Chinmay Gupté, a clinician registered with the General Medical Council (GMC reference 4342319), and are subject to the professional standards set by the GMC.
All clinical services are delivered at hospitals and clinics that are registered with the Care Quality Commission (CQC). Sports Healing Ltd does not itself hold a CQC registration; the CQC registration for the setting in which you are seen is held by the hospital or clinic concerned, and its details are available on request and from the CQC at cqc.org.uk.
14. Changes to these Terms
We may update these Terms from time to time. The current version is always available on the Websites, and the “last updated” date at the top shows when they last changed. Your continued use of the Websites after a change means you accept the updated Terms.
15. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them or the Websites, are governed by the law of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may also bring proceedings in your home jurisdiction.
